1. General Information
This online store is operated by:
Volodymyr Kazonnikov
Isländische Straße 9 10439 Berlin Germany
Email: volodymyrkazonnikov@gmail.com
Trading as: Circumstance
Website: circumstance.online
In these Terms of Service, “we”, “us”, and “our” refer to the operator of this store. “You” and “your” refer to visitors and customers.
These Terms govern your use of our website and purchases made through our online store.
By using our website, you agree to these Terms to the extent applicable law permits. Your statutory consumer rights are not limited or excluded by these Terms.
2. Our Products
We design and sell clothing and fashion products under our own brand. Product descriptions, photographs, materials, sizing information, prices, and availability are provided on the relevant product pages.
We make reasonable efforts to represent our products accurately. However, colours may appear differently depending on your screen, device, and display settings.
As some products may be made or finished by hand, minor variations in appearance, texture, measurements, or finish may occur where consistent with the product description and applicable legal requirements.
Such variations do not exclude your statutory rights where a product does not conform to the contract.
Product availability may change. We reserve the right to discontinue products or update product information, subject to existing contractual obligations and applicable law.
3. Prices and Taxes
All prices are displayed in the currency indicated in our store.
Applicable shipping costs and other charges will be disclosed before you place your order.
Unless expressly stated otherwise, product prices do not include customs duties, import taxes, or other charges that may be imposed by the destination country.
We operate under the German small-business VAT scheme (Kleinunternehmerregelung) where applicable. Where the statutory conditions are met, German VAT is not charged in accordance with Section 19 of the German VAT Act (Umsatzsteuergesetz).
The tax treatment of cross-border sales may depend on the destination, the transaction, and applicable law.
4. Orders and Contract Formation
Product listings on our website constitute an invitation to place an order and are not necessarily a binding offer.
When you submit an order through checkout, you make an offer to purchase the selected products.
An automated order confirmation acknowledges receipt of your order and does not, by itself, necessarily constitute acceptance.
The purchase contract is concluded when we expressly accept your order, confirm shipment, or otherwise accept it in accordance with the checkout process and applicable law.
We reserve the right to refuse or cancel an order where legally justified, for example where a product is unavailable, a pricing error has occurred, or a transaction is reasonably suspected to be fraudulent. If payment has already been collected for an order we cancel, we will arrange an appropriate refund.
You are responsible for providing accurate contact, billing, and delivery information.
5. Payment
Available payment methods are displayed at checkout and may include:
-
Shopify Payments;
-
PayPal;
-
Klarna.
Payment processing is handled by the relevant payment provider under its applicable terms and conditions.
You agree to provide accurate payment information and to use only payment methods you are authorised to use.
Where a payment provider offers instalments, deferred payment, or other financing options, those arrangements may be subject to separate eligibility requirements and contractual terms imposed by that provider.
6. Shipping and Delivery
We ship orders using DHL and, where necessary, relevant delivery partners.
Available destinations, shipping methods, costs, and estimated delivery times are displayed during checkout or in the applicable shipping information.
Delivery estimates are provided in good faith but may be affected by circumstances beyond our reasonable control, including customs procedures, carrier delays, incorrect delivery information, or events affecting international transport.
We will comply with applicable statutory delivery obligations. Where no other delivery period has been agreed, mandatory legal delivery deadlines apply.
For international shipments, customs duties, import taxes, brokerage fees, and similar charges may be payable by the recipient unless the checkout or applicable shipping terms expressly state otherwise.
Customers are responsible for providing a complete and accurate delivery address and for complying with applicable import requirements. These responsibilities do not exclude any obligations imposed on us by law.
If a shipment is delayed, lost, or damaged, please contact us at volodymyrkazonnikov@gmail.com with your order number. We will review the matter and cooperate with the relevant delivery provider.
Nothing in these Terms transfers to the customer any risk that applicable consumer law requires us to bear.
7. Right of Withdrawal and Returns
Consumers may have a statutory right to withdraw from an online purchase without giving a reason.
For many consumer purchases in the European Union, the withdrawal period is 14 days from the date the customer or an eligible designated recipient receives the goods. Different rules and exceptions may apply depending on the jurisdiction and transaction.
The statutory withdrawal right does not apply to every product. For example, applicable law may exclude goods made to the consumer's specifications or clearly personalised goods.
The fact that a garment is handmade or produced in a small batch does not, by itself, remove a consumer's statutory withdrawal right.
Where a withdrawal right applies, the customer must follow the instructions in our separate Withdrawal Policy (Widerrufsbelehrung).
Return shipping costs, refund deadlines, and other withdrawal conditions are governed by applicable law and the information provided before purchase.
This section does not limit statutory remedies for defective, damaged, or incorrectly supplied products.
8. Faulty or Incorrect Products
We are responsible for ensuring that products conform to the contract as required by applicable law.
If you receive a defective, damaged, or incorrect product, please contact us at volodymyrkazonnikov@gmail.com and provide your order number and a description of the issue. Photographs may help us assess the matter.
Your statutory rights may include repair, replacement, a price reduction, or a refund, depending on the circumstances and applicable law.
Nothing in these Terms excludes or limits mandatory consumer rights or liability that cannot legally be excluded or limited.
9. Custom-Made and Personalised Products
Some products may be offered with individual measurements, specifications, or other personalisation.
Where a product is genuinely made to the customer's specifications or clearly personalised, a statutory exception to the right of withdrawal may apply.
Any applicable exception will be assessed according to the product and the relevant law. It will not automatically apply to every handmade garment, made-to-order product, or item produced after an order is received.
Customisation details, measurements, prices, and any relevant cancellation conditions will be communicated before the order is finalised.
10. Intellectual Property
Unless otherwise stated, the content of this website, including brand names, logos, product photographs, designs, graphics, text, and other creative materials, is owned by us or used with permission.
You may not reproduce, distribute, modify, publish, or commercially exploit our content without prior written permission, except where permitted by applicable law.
Purchasing a product does not transfer ownership of intellectual property rights in the product design, brand, photographs, or other protected content.
11. Website Use
You agree not to use our website unlawfully, interfere with its operation, attempt unauthorised access, introduce malicious code, or engage in fraudulent activity.
We may restrict or suspend access where reasonably necessary to protect the website, customers, or our business, subject to applicable law.
We may update, maintain, or temporarily suspend parts of the website when necessary. Such actions do not affect rights arising from an existing purchase contract.
12. Limitation of Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
In particular, we remain liable in accordance with applicable law for intentional misconduct, gross negligence, injury to life, body or health, and other liability that cannot legally be excluded or limited.
Where legally permitted, liability for other breaches of contractual obligations is governed by the applicable statutory rules.
Nothing in this section restricts mandatory consumer protection rights.
13. Privacy
Personal data is processed in accordance with our Privacy Policy, available here.
The Privacy Policy explains what personal data we collect, why we process it, which recipients may receive it, and how you may exercise your applicable data protection rights.
14. Governing Law and Consumer Rights
These Terms are governed by the laws of the Federal Republic of Germany, subject to mandatory provisions of applicable law.
If you are a consumer residing in another country, this choice of law does not deprive you of protection afforded by mandatory provisions that apply to your contract under the relevant conflict-of-law rules.
Nothing in these Terms limits rights that consumers cannot waive under applicable law.
15. Changes to These Terms
We may update these Terms to reflect changes to our business, products, website, or legal requirements.
The version applicable to an order will be determined in accordance with the contract and applicable law. Changes will not retroactively remove rights already acquired under an existing contract.
The latest version will be published on this page with its updated date.
